Performing Rights

This is simply the right to perform music compositions publily. Copyright law, controls performing rights. And is what demands payment, for such public performances.

Nightclubs, restaurants, concerts etc. Cable television, radio, and any other transmitted performance, like the internet. All forms of broadcasting.

In general, there are 2 methods of gaining permission to publicly perform music compositions in the United States.

  • 1. You could directly enter into a licensing agreement with the copyright owner.
  • 2. Option two would be the more customary method. Which would be to enter into a licensing agreement with one of the major performing rights organizations, such as ASCAP, BMI and SESAC.

Once the performing rights organization receives licensing payment from the broadcaster. The broadcaster is granted use of all the music in their repertoires  Then the performing rights organization is responsible for distribution of payment to the music authors and publisher.

SESAC SESAC was founded in New York in 1930 by German immigrant Paul Heinecke

Larry Gene Music, is BMI affiliated.
